Important: These Terms govern purchases and use of Jewelry Keepsakes websites and services. Please read them carefully, especially the sections concerning personalized products, memorial materials, returns, warranty, and limitations of liability.
1. Acceptance of These Terms
These Terms & Conditions ("Terms") are a binding agreement between you and Jewelry Keepsakes Inc. ("Jewelry Keepsakes," "we," "us," or "our"). They govern your access to and use of our websites, online store, products, customer-service channels, and related services (collectively, the "Services").
By accessing the Services, creating an account, placing an order, submitting materials for personalization, or otherwise using the Services, you agree to these Terms and to the policies incorporated by reference, including our Privacy Policy, Returns Policy, Warranty, and any product-specific instructions or disclosures presented before purchase. If you do not agree, do not use the Services or place an order.
If you place an order on behalf of another person, business, estate, or organization, you represent that you are authorized to act for that person or entity and to accept these Terms on its behalf.
2. Eligibility and Lawful Use
You must be legally capable of entering into a binding contract to make a purchase. If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.
You may not use the Services for unlawful, fraudulent, abusive, or infringing purposes; interfere with the security or operation of the Services; attempt to gain unauthorized access to accounts or systems; scrape or copy the Services in a manner that violates applicable law or our rights; or submit materials that you do not have the right to use.
3. Product Information and Availability
We make reasonable efforts to describe and display our products accurately. Because jewelry is photographed under particular lighting and displayed on different screens, colors, finishes, stone appearance, scale, and other visual characteristics may look different in person. Measurements and weights may be approximate unless expressly stated otherwise.
Many of our products are handcrafted, hand-finished, personalized, or produced to order. Minor differences in engraving placement, polishing, oxidation, texture, stone appearance, dimensions, or other characteristics are normal and are not necessarily defects. Natural stones and materials may vary in color, inclusions, pattern, and appearance.
Product availability, materials, finishes, components, and specifications may change. We may discontinue or modify products without notice. If a material or component becomes unavailable after you order, we will contact you when a material substitution or material change would meaningfully affect the item you purchased.
4. Orders and Acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance. We may decline, cancel, or limit an order before fulfillment for reasons such as suspected fraud, payment problems, product or material unavailability, pricing or description errors, legal restrictions, or inability to complete a requested personalization.
If we cancel an order after payment has been captured, we will refund the amount paid for the canceled portion using the original payment method unless another method is required by law or agreed with you.
You are responsible for reviewing all order details, including spelling, dates, quantities, sizes, shipping address, personalization instructions, and uploaded materials before submitting an order and again when we request approval.
5. Pricing, Taxes, and Payment
Prices are shown in the currency displayed at checkout and may change without notice. The price applicable to an order is the price presented when the order is submitted, subject to correction of obvious errors. Discounts, coupons, promotions, and special offers are subject to their stated terms and may not be combined unless expressly permitted.
Applicable taxes, shipping charges, and other fees will be displayed at checkout when required or reasonably practicable. You authorize us and our payment providers to charge the payment method you select for the total amount due.
Payment processing is provided through Shopify and/or other payment providers made available at checkout. Your use of a particular payment method may also be subject to the payment provider's terms and privacy practices.
6. Personalized and Custom Products
A substantial portion of Jewelry Keepsakes products are personalized, custom, made-to-order, or created using materials or information you provide. These products may include engraving, photographs, handwriting, signatures, fingerprints, names, dates, custom artwork, memorial text, birthstones, cremation ashes, or other customer-selected elements.
You are responsible for providing complete and accurate personalization instructions. We may make minor production adjustments that are reasonably necessary to fit text, images, fingerprints, handwriting, or other content within the available design area while preserving the overall requested appearance.
If a proof or artwork approval is provided, you are responsible for carefully reviewing it. Approval authorizes us to proceed based on the approved proof. Errors visible in an approved proof, including spelling, dates, layout, or image selection, may not qualify as manufacturing defects.
Once work has begun on a personalized or custom item, changes or cancellation may be impossible or may involve charges for work already performed, materials committed, or components already created. Our Returns Policy and any product-specific cancellation terms control where they provide more specific rules.
7. Customer-Provided Photos, Fingerprints, Handwriting, Artwork, and Other Content
When you submit a photograph, fingerprint, signature, handwriting sample, drawing, logo, text, image, artwork, design direction, or other content ("Customer Content"), you represent and warrant that you own the Customer Content or have all permissions, licenses, consents, and authority necessary for us to use it to provide the requested product or service.
You must not submit Customer Content that infringes intellectual-property, privacy, publicity, or other rights; is unlawful; or that you are not authorized to provide. If Customer Content includes another person's image, fingerprint, handwriting, signature, or other personal material, you represent that you have authority or permission appropriate to your requested use.
You retain ownership of rights you hold in your Customer Content. You grant Jewelry Keepsakes a non-exclusive, worldwide, royalty-free license to receive, reproduce, crop, resize, edit, convert, engrave, manufacture from, transmit to production providers, and otherwise use the Customer Content as reasonably necessary to fulfill your order, provide customer service, maintain production records, address warranty or remake requests, prevent fraud, and comply with law.
We do not claim ownership of your personal photographs, fingerprints, handwriting, or signatures merely because you submit them to us. Any broader promotional use of identifiable customer-supplied memorial materials would require a separate basis or permission where required.
8. Cremation Jewelry, Ashes, and Memorial Materials
Certain products are designed to hold, incorporate, seal, or otherwise use a small amount of cremated remains or other memorial material. Follow the instructions we provide for the specific product and send only the amount requested. Do not send irreplaceable quantities of ashes or memorial material.
You represent that you are legally authorized to possess, handle, ship, and instruct us to use any cremated remains or memorial materials you provide. You are responsible for resolving any family, estate, custodial, religious, or ownership disputes concerning those materials before sending them to us.
Unless we provide a prepaid or specially designated shipping method, you are responsible for choosing an appropriate carrier and shipping method and for complying with carrier and legal requirements for transporting cremated remains or other memorial materials. Risk of loss before materials are received by us remains with the sender except where applicable law provides otherwise.
We handle memorial materials with care and use reasonable procedures intended to keep customer materials associated with the correct order. Because very small particles may adhere to containers, tools, packaging, or the product during normal handling and production, we cannot guarantee recovery or return of every microscopic particle. Any unused material that is returnable will be handled according to our then-current process or product instructions.
For permanently sealed or filled jewelry, opening, altering, repairing, or resizing the item after sealing may not be possible without affecting the seal or the memorial material. Product-specific care, warranty, and repair limitations apply.
9. Proofs, Approvals, and Production
Some products require a proof, image preparation, or design approval before production. Delays in responding to proof requests, providing usable files, supplying personalization details, or sending memorial materials may delay production and delivery.
Estimated production times are estimates, not guaranteed completion dates, unless we expressly agree in writing to a guaranteed deadline. Production time generally begins only after we have received all required information, approvals, payment, and customer-supplied materials.
Rush service, if offered, accelerates production according to the option purchased but does not eliminate carrier delays, weather events, payment reviews, customer approval delays, material shortages, or other circumstances outside our reasonable control.
10. Shipping, Delivery, and Risk of Loss
Shipping and delivery estimates are provided for convenience and are not guarantees unless expressly stated. Once an order is tendered to a carrier, delivery timing is affected by the carrier and circumstances outside our direct control.
You are responsible for providing a complete and accurate shipping address. Additional charges caused by an incorrect address, refused delivery, or repeated delivery attempts may be your responsibility to the extent permitted by law.
Title and risk of loss for merchandise pass as provided by applicable law and the shipping terms associated with the order. If tracking shows a package as delivered but you cannot locate it, contact us promptly so we can assist with available carrier procedures. Claims for damaged, missing, or lost shipments may require photographs, packaging, carrier documentation, affidavits, or other reasonable information.
International orders may be subject to import duties, taxes, brokerage charges, customs delays, restrictions, or other fees imposed by the destination country. Unless checkout expressly states otherwise, the recipient is responsible for such charges.
11. Order Changes and Cancellations
Contact us promptly if you need to change or cancel an order. We will make reasonable efforts to help, but we cannot guarantee that changes or cancellations can be made after an order enters production, engraving, personalization, procurement, or fulfillment.
Custom and personalized products may be non-cancelable once production begins. If we agree to a cancellation after work has started, we may deduct reasonable costs already incurred where permitted by law. Nothing in this section limits rights that cannot legally be waived.
12. Returns and Exchanges
Returns and exchanges are governed by our current Returns Policy, which is incorporated into these Terms by reference. Because personalized, engraved, custom, and memorial products are made specifically for the customer, they may be excluded from ordinary returns or exchanges except where required by law or where the product is defective or we made an error covered by our policy.
Do not send merchandise, ashes, or other materials back without following the return authorization or shipping instructions we provide. Unauthorized returns may be delayed or refused to the extent permitted by law.
13. Warranty, Repairs, and Product Care
Our products are subject to the Warranty in effect for the product at the time of purchase. The Warranty is incorporated into these Terms by reference and controls warranty coverage, exclusions, claim procedures, and remedies.
Jewelry requires appropriate care. Exposure to chemicals, chlorine, salt water, cosmetics, impact, abrasion, improper cleaning, unauthorized repair, resizing, modification, or use inconsistent with product instructions may damage jewelry and may affect warranty coverage. Cremation jewelry and permanently sealed products may have additional care restrictions.
Normal wear, tarnish, scratches, plating wear, accidental damage, loss, theft, misuse, and changes caused by ordinary aging of materials are not manufacturing defects unless the applicable Warranty states otherwise.
14. Intellectual Property
The Services and materials created or owned by Jewelry Keepsakes, including our website content, product photography, text, graphics, logos, trademarks, trade dress, original jewelry designs, design files, molds, models, production methods, artwork created by us, and other proprietary materials, are owned by Jewelry Keepsakes or our licensors and are protected by intellectual-property laws.
Except as expressly permitted, you may not reproduce, distribute, sell, sublicense, commercially exploit, reverse engineer, copy, create derivative products from, or use our proprietary designs or content without written permission.
A customer's ownership of Customer Content does not transfer ownership of Jewelry Keepsakes' pre-existing designs, production files, templates, jewelry models, tooling, methods, or other intellectual property used to create a product. Unless we agree otherwise in writing, custom design work does not constitute an assignment of our intellectual-property rights.
15. Reviews and User-Generated Content
You may have opportunities to submit reviews, testimonials, photographs, questions, or other content through our website or third-party review providers. You are responsible for content you submit and represent that you have the right to submit it.
For content you intentionally submit for public display, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that content for operating, improving, and promoting the Services, subject to applicable privacy law and any additional terms presented when you submit it.
We may moderate or remove content that is unlawful, deceptive, abusive, infringing, unrelated, contains sensitive personal information, or otherwise violates these Terms or the rules of the applicable review platform. We are not obligated to publish every submission.
16. Accounts and Communications
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring under your account. Notify us promptly if you believe your account has been compromised.
By providing contact information in connection with an order, you authorize us to send transactional communications reasonably related to the order or customer-service relationship. Marketing communications are governed by applicable law and our Privacy Policy, and you may unsubscribe from promotional email using the unsubscribe mechanism provided.
17. Third-Party Services and Links
The Services may rely on or link to third-party services such as Shopify, payment providers, shipping carriers, review platforms, analytics providers, social networks, or other websites. Those services are operated independently and may have their own terms and privacy practices.
We are not responsible for third-party websites, content, products, or services solely because we link to or integrate with them. Your dealings with a third party may be governed by a separate agreement between you and that third party.
18. Privacy
Our collection, use, sharing, and protection of personal information are described in our Privacy Policy. By using the Services, you acknowledge that personal information will be handled as described in that policy and applicable privacy notices.
Where the Services provide cookie, consent, or privacy preference controls, those controls supplement the Privacy Policy and may vary based on location and applicable law.
19. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCEPT FOR EXPRESS WARRANTIES PROVIDED IN OUR WRITTEN WARRANTY OR THAT CANNOT LEGALLY BE DISCLAIMED, THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
We do not warrant that the website will always be uninterrupted, error-free, or free from harmful components, or that every product photograph will exactly reproduce the appearance of a handcrafted or naturally variable item. Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEWELRY KEEPSAKES AND ITS OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT, ORDER, OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO JEWELRY KEEPSAKES FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM, EXCEPT WHERE APPLICABLE LAW REQUIRES A DIFFERENT REMEDY OR LIMITATION.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from fraud, willful misconduct, or other liability that applicable law requires us to bear.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Jewelry Keepsakes and its officers, employees, agents, contractors, and affiliates from third-party claims, damages, liabilities, losses, and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, or Customer Content or materials you submit that infringe or violate another person's rights. This obligation does not apply to the extent a claim results from our own wrongful conduct.
22. Events Beyond Our Reasonable Control
We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, natural disasters, fire, transportation disruptions, carrier failures, labor disputes, governmental actions, epidemics or public-health events, utility or internet outages, cyber incidents affecting third parties, material shortages, supplier failures, or similar events. We will make reasonable efforts to communicate material delays and resume performance when practicable.
23. Governing Law and Disputes
These Terms and disputes arising from them are governed by the laws of the State of Montana, without regard to conflict-of-law principles, except to the extent the laws of your jurisdiction provide consumer protections that cannot be waived by contract.
Before filing a lawsuit, we encourage you to contact us so that we can try to resolve the matter directly. Unless applicable law requires otherwise, legal proceedings arising from these Terms or the Services may be brought in a state or federal court having jurisdiction in Cascade County, Montana, and you consent to personal jurisdiction and venue there.
These Terms do not require arbitration and do not waive any right to a jury trial unless you and Jewelry Keepsakes later agree to such a procedure in a separate enforceable agreement.
24. Changes to the Services and These Terms
We may update these Terms from time to time to reflect changes in our products, practices, technology, policies, or legal obligations. The revised Terms will be posted with a new Last Updated date. Changes apply prospectively unless applicable law permits otherwise.
Terms applicable to a completed purchase generally remain those in effect when the order was placed, except where a later change is required by law or expressly agreed by the parties.
25. General Provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of our right to enforce it later.
These Terms, together with policies and product-specific terms incorporated by reference, constitute the agreement between you and Jewelry Keepsakes concerning the subject matter they cover. If a product-specific written term conflicts with these general Terms, the more specific term controls for that product or transaction.
Headings are for convenience only and do not limit the meaning of these Terms.
